California Lemon Law Buyback Guide & Calculator (2026)
The California Lemon Law (officially the Song-Beverly Consumer Warranty Act) provides essential, powerful protections for consumers who have purchased or leased defective vehicles in the state of California.
Under California Civil Code §1793.22, if a manufacturer or its authorized dealer cannot repair a vehicle to conform to the warranty after a "reasonable number of attempts," the manufacturer is legally obligated to either promptly replace the vehicle or provide a full refund of the purchase price, less a strict statutory mileage offset.
How the Lemon Law Refund is Calculated
Our 2026 calculator utilizes the exact mathematical formula outlined in California law. The offset—which is the amount deducted for the value you received while driving the car before it broke down—is calculated as:
(Mileage on the odometer at the very first repair attempt for the defect / 120,000) x Total Purchase Price.
The Total Purchase Price includes your cash down payment, all monthly payments you've made, the payoff of your remaining loan balance, and collateral state charges like registration fees, license fees, and sales taxes.
Qualifying for a Claim
To qualify, the vehicle typically must have suffered a defect that substantially impairs its use, value, or safety. Common examples include transmission failures, engine stalling, electrical shorts, or braking issues. Repeated visits to the dealer (often 2+ for safety issues, 4+ for others, or 30+ cumulative days out of service) are required to establish a valid claim.
Pasos a Seguir
